Hakim: Najib berkuasa mutlak, bukan Agong....

"Saya selaku seorang peguam yang sedang menamatkan PhD diluar negara berasa pelik dengan keputusan terkini hakim yang mengesahkan pemecatan Anwar dahulu kerana "kuasa PM mutlak manakala bidangkuasa Agong terhad' sedangkan bidangkuasa Sultan Perak dalam memutuskan isu MB tidak pula dikatakan 'terhad'. Seperti ada unsur double standard. Justeru, saya yakin rakyat biasa di kampung akan lebih keliru. Tindakan ini secara tidak langsung mengatakan bahawa Najib berkuasa mutlak dalam melantik dan memecat sesiapa. Keratan akhbar disertakan:

PUTRAJAYA: Only the Prime Minister has the power to appoint and revoke the appointment of Cabinet ministers, the Federal Court ruled.

It said the Yang di-Pertuan Agong as a constitutional monarch had a very limited role concerning the appointment of Cabinet members.

The Federal Court said this yesterday in rejecting Datuk Seri Anwar Ibrahim’s appeal against the Court of Appeal’s decision that his dismissal as Deputy Prime Minister (DPM) and Finance Minister on Sept 2,1998, by then Prime Minister Tun Dr Maha­thir Mohamad was lawful.


Anwar had challenged his dismissal on the grounds that Article 43(5) of the Federal Constitution specifically required the King to be the authority which revokes the appointment of a DPM and Finance Minister, having regard to the principle that it is only the authority which appoints that has the right to revoke any appointment made by it.

In a unanimous decision, however, Court of Appeal President Justice Alauddin Mohd Sheriff who chaired the three-man panel also comprising Federal Court Justices Mohd Ghazali Mohd Yusoff and Abdull Hamid Embong, said “the power to choose and appoint ministers resides with the Prime Minister.” -tamat-

Menurut tafsiran dan pemahaman saya, yang mungkin salah, kesan kes ini ialah mengesahkan bahawa kuasa Najib adalah 'mutlak' dalam memecat sesiapa yang dikehendakinya manakala peranan Agong pula terhad.

Dalam kes Perak, peranan dan kuasa Sultan ketika melantik Zambry pula dihormati. Memang pelik.

Lebih pelik bila hakim sebulat suara dalam kes Zambry (5-0) mengesahkan perlantikan Zambry. Dalam kes Anwar pun, kesemua hakim sebulat suara bahawa Anwar patut dipecat.

Fakta bahawa hakim kerap sebulat suara dalam kes-kes yang memenangkan BN kelihatan misteri.
